If you and your spouse can agree on most–if not all–issues in your divorce, an uncontested divorce may be the most affordable and efficient way to go. Let us take care of the paperwork and the legwork. We will draft and file all of the necessary paperwork for your uncontested divorce. Save time, save money, and stay out of court.
How it Works We represent and work only with the petitioner, or moving party, in a divorce action to draft, execute, and file all necessary paperwork for a Utah divorce. The petitioner and attorney work together to draft the terms of the agreement or stipulation that both spouses sign. The uncontested divorce flat fee of $780 (no children)** or $990 (with minor children)** includes three free (3) "edit and review" sessions and up to three (3) free hours of attorney face-time, not including the initial consultation.
**This flat fee does not include the $318 filing fee.
**Additional special court orders needed to divide retirement accounts, such Domestic Relations Orders (DROs) and Qualified Domestic Relations Orders (QDROs) are not included. We can help you draft and establish a DRO or QDRO in your divorce for a separate fee.
Why an Uncontested An uncontested divorce is not for everyone. It is important to choose the right path forward that works best for your situation. If you and your spouse are in agreement on the issues, an uncontested divorce can be a much simpler approach.
We offer three options for assistance for uncontested divorce actions: (1) Attorney-Assisted Uncontested Divorce; (2) limited scope legal consulting; and (3) DIY Divorce - via Evorce our online legal divorce workshop/course for Utah filers.
1. Attorney-Assisted Uncontested Divorce
The first option is what I call an "attorney-assisted uncontested" divorce. This is where we prepare and electronically file all documents necessary to effect a divorce. Due to conflicts of interest rules and ethics, I can only represent one party--usually the Petitioner. I prepare a "Stipulation & Property Settlement Agreement" that is signed by both parties. I work with one party to provide me the details necessary for the agreement. We prepare and submit the Decree of Divorce and the Findings of Fact and Conclusions of Law to the assigned judge to your case for official approval and entry by the clerk of court.
The fee for this is $780 attorney fee + $318 filing fee for those with no minor children.
The fee for those with minor children is $990 attorney fee + $318 filing fee.
These packages include three (3) hours of attorney face-time and 3 edit & review sessions
2. Limited Scope Consulting for Uncontested Divorce
The second option is to purchase a legal consulting package for as-needed advice and assistance. With this option you prepare and file your own divorce papers. When advice and/or assistance is needed, appointments can be scheduled directly on my calendar. Time purchased in a package can be used for attorney face-time (either in-person or via video conference), document preparation consultations, legal advice consultations, etc. Legal consulting packages are sold by the hour ($185/hour) or in discount packages: 3-hour package ($500), 5-hour package ($800), and 10-hour package ($1,500).
