Uncontested Divorce in Utah: What It Really Means and How We Help

Looking for an 'uncontested divorce' in Utah? You're not alone. In fact, it's one of the most common requests we receive. While 'uncontested divorce' isn't technically a legal process (it's actually an outcome . . . and a great goal), we understand exactly what you're looking for: a peaceful, cooperative divorce that avoids court battles and keeps costs reasonable.
Picture

Peaceful. Private. Cost-Effective.

You’re here because you want a peaceful divorce. You and your spouse are on the same page—or close to it—and you're both committed to staying out of court. You’d rather work together than battle it out.

That’s exactly what an uncontested divorce is for. Whether you already have an agreement or need a little guidance to get there, I help individuals complete the legal process in a cost-effective and efficient manner—without setting foot in a courtroom.

I’ll guide you through each step, from drafting your documents, securing that agreement in writing (an absolute must), to filing with the court, all online and all at a flat, affordable rate.

The Benefits You're Looking For in a Legal Process:

  • No court appearances
  • No escalating conflict
  • Low flat fees--no surprise billing
  • Fast, efficient process—done entirely online
  • Legal advice—without the hidden costs or adversarial approach
  • Private and confidential
  • Designed to reduce stress, not add to it

Here's What Uncontested Really Means In Legal Terms

Unless your situation qualifies for a 'default divorce,' you’ll need to either litigate your case or reach a full settlement before a 'Decree of Divorce' will be granted by the district court. There’s no such thing as an automatic or truly “easy” divorce—and mediation or negotiation is often required, no matter which route you take.

In Utah, uncontested divorce is not a process—it’s an outcome. To reach that outcome, you and your spouse need to reach a global agreement—a written, signed resolution of all legal issues, including property, debts, custody, parenting time, child support, and alimony. Without a complete agreement in writing and signed by both parties, your divorce is not uncontested—no matter how amicable things may feel.

Reaching an uncontested outcome is the most peaceful, efficient, and cost-effective way to finalize your divorce—but unless your case is the simplest of all simple cases, it will still require clear communication, legal knowledge, and careful preparation. If you're ready to work toward that outcome, you're already one step ahead.

How We Can Help You Achieve an 'Uncontested' Outcome

If you and your spouse are committed to working together respectfully and want to stay out of court, an 'uncontested divorce' may be the ideal outcome. But getting there doesn’t happen by chance—it takes the right strategy from the start.
We’ll help you determine the best path forward based on your unique situation. It begins with careful planning, education, and preparation—especially in how you approach your spouse. Whether your case ends in agreement or litigation, how you start your divorce sets the tone for everything that follows.

Begin with My Divorce Launchpad

This is our exclusive legal program designed to you total preparation and expert support to start your divorce the right way. By the end, you’ll:
  • have a structure for a solid, legal divorce agreement that could be the basis for your uncontested divorce, if one is realistic in your case; or
  • walk away with the knowledge, education, and preparation about what further action or details are needed in order to reach a cooperative or Collaborative agreement
  • You'll have clarity about whether a cooperative approach, aCollaborative approach, or litigation is better suited to your situation
  • If adversarial litigation is likely—you'll learn how to handle it strategically
This is the gateway to a better divorce. It’s practical, affordable, and designed to give you clarity, confidence, and direction from day one. There’s no reason not to start here.

  • Phase 1: Set Your Foundation
Before you file a divorce, take time to prepare for the journey ahead. Gather financial documents, understand your legal rights, develop a negotiation strategy, and set realistic goals.
  • Phase 2: Choose Your Legal Process
Approach your divorce like the process that it is. Now is the time to consider how much you want to be involved in the process. Do you want lawyer representation? Or to do this process fully DIY? Will a kitchen table negotiation be enough? Or should you try mediation? Or the Collaborative process? Will litigation be necessary as a last resort?
  • Phase 3: Problem-Solve and Resolve Legal Issues
We'll help guide you through your chosen alternate dispute resolution process from start to finish.
  • Phase 4: File Uncontested/Negotiated Divorce & Await Official Entry
We'll obtain signatures and approvals and file your uncontested or negotiate divorce with the court. We'll also monitor your case until it's approved and entered as an official, legal divorce.

Why Uncontested Divorce in Utah is Often the Best Choice

In Utah, an uncontested divorce is an excellent option for couples who can resolve their issues outside of court. This process eliminates the need for court appearances and streamlines your path to a finalized divorce. You may qualify for an uncontested divorce under one of two scenarios:

Scenario 1: A Full Settlement Agreement
You and your spouse have reached a written agreement that resolves all major issues, including:
  • Child custody and child support (if applicable)
  • Spousal support (alimony)
  • Division of property and debts
  • Legal fees or counsel costs
This is often referred to as a "settlement agreement" uncontested divorce.

Scenario 2: No Major Assets or Disputes
You and your spouse:
  • Have no children
  • Own no significant assets (e.g., a house, bank accounts, or other property)
  • Have no marital debts to divide
  • Earn roughly the same income

If you fall into either category, you can file for an uncontested divorce. This involves submitting detailed paperwork to the court, which a judge will review. If everything is in order, the judge will sign off on your Judgment of Divorce, finalizing the process.

Why You Should Seek Legal Guidance
While it’s possible to handle an uncontested divorce without an attorney, doing so can put your rights at risk. Utah’s divorce laws are complex, and small mistakes can have long-lasting consequences. At the very least, consulting with a qualified family law attorney can help you identify potential red flags and ensure your agreement is legally sound.

Ready to Start? I can help you draft, review, and file the necessary documents to complete your uncontested divorce quickly, affordably, and without stepping foot in a courtroom.
